Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and the Basan security platform (together, the "Service") provided by Basan ("Basan", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

The Service

Basan is an agentic security platform that helps you schedule and run automated security testing against targets you own or are authorized to test, and that reports the findings it discovers. The Service is provided as a tool to assist your security program. It does not guarantee that every vulnerability will be found, and it is not a substitute for your own security judgment or professional advice.

Eligibility and accounts

You must be at least 18 years old to use the Service. You are responsible for the information in your account, for keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly at support@basan.ai if you suspect any unauthorized use.

Authorized testing only

This is the most important term in this agreement. You may only direct the Service to test targets that you own or for which you have explicit, current authorization from the owner to conduct security testing. By starting a scan, you represent and warrant that:

• You own the target or have written authorization to test it;
• Your use complies with all applicable laws, including computer-misuse and anti-hacking laws;
• Your testing does not violate any third party's rights or any agreement you have with a hosting provider or other party.

You are solely responsible for the scope you configure and for the consequences of testing you authorize. We require domain verification before a scan can run, but verification does not transfer responsibility for authorization to us. If we believe testing is unauthorized or unlawful, we may suspend or terminate it without notice.

Acceptable use

You agree not to:

• Use the Service to test systems you are not authorized to test;
• Use the Service to cause harm, disruption, or denial of service beyond the testing you are authorized to perform;
• Reverse engineer, resell, or provide the Service to third parties except as expressly permitted;
• Interfere with or circumvent the security, rate limits, or access controls of the Service;
• Use the Service to violate any law or the rights of others.

Credits, plans, and billing

Access to the Service is organized into plans, and scans are dispatched using credits. Each scan you dispatch consumes credits as described in the Service. Paid plans and credit purchases are billed through our payment provider. Credits are a prepaid entitlement to use the Service and are non-refundable except where required by law. We do not refund or restore credits based on the outcome of a scan, including scans that find no issues. Plan features may change between tiers; downgrading a plan may remove access to paid features and stop recurring actions that depend on them.

Subscriptions, renewals, and cancellation

Paid plans are offered on a recurring subscription basis and renew automatically for successive billing periods until cancelled. By subscribing, you authorize us, through our payment provider, to charge the applicable fees to your payment method at the start of each billing period. You may cancel renewal at any time through your account or by contacting us; cancellation takes effect at the end of the current billing period, and you will retain access until then. Fees are exclusive of taxes, and you are responsible for any applicable taxes. We may change our fees on prospective notice, effective as of your next billing period.

Your content and findings

You retain ownership of the targets, configuration, and credentials you provide, and of the findings and reports the Service generates for you. You grant us the limited rights needed to operate the Service, run the scans you request, and store and display your data to you. We may use aggregated, de-identified information that does not identify you or your targets to operate and improve the Service.

Feedback

If you give us suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.

Third-party services

The Service relies on third-party providers for functions such as hosting, payments, email, AI models, and optional integrations you enable. Your use of those integrations may be subject to their own terms. We are not responsible for third-party services we do not control.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that it will detect all vulnerabilities or secure your systems.

Limitation of liability

To the maximum extent permitted by law, Basan and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service will not exceed the amounts you paid us for the Service in the 12 months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Basan from any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your testing of any target, including any claim that your testing was unauthorized.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

Dispute resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@basan.ai, and we will try to resolve it with you in good faith. If we cannot resolve a dispute within 30 days, either party may bring the dispute before the courts identified in the Governing law section below.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and Basan agree to the exclusive jurisdiction of the state and federal courts located in that jurisdiction for any dispute arising out of or relating to these Terms or the Service.

General

• Changes to the Service. We may add, change, or discontinue features of the Service over time.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Severability and waiver. If any provision is found unenforceable, the rest remains in effect, and our failure to enforce a provision is not a waiver of it.
• Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms, are the entire agreement between you and Basan regarding the Service.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
• Export and sanctions. You represent that you are not located in, and will not use the Service in, a jurisdiction subject to sanctions that would make your use unlawful.
• Notices. We may give notice to you by email or through the Service; you may give notice to us at the contact address below.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
